Prochaska v. Prochaska (Nebraska 2009)

When setting a child support obligation for an obligor with multiple families, the court may deviate from a strict application of the guidelines as long as it considers the facts of the case. A deduction is appropriate if a strict application of the facts would be unjust or inappropriate. In this case, the court, when modifying a support order, properly gave an NCP credit for his obligation to support a child from his second marriage.
